On December 13, Artificial intelligence and data protection - was the cutting-edge topic of the DatenTag ONLINE. High-ranking experts presented exciting theses and facts on the benefits and risks of artificial intelligence with regard to data protection law. Professor Dr. Georg Borges presented his expert opinion under the heading of "Potentials of Artificial Intelligence with regard to Data Protection Law" which initiated a fruitful discussion on the topic. 

How does artificial intelligence impact our lives? The fear that AI will replace human decision making  is widespread. But can data protection help to regulate AI? Professor Dr. Anne Riechert and Frederick Richter from the Stiftung Datenschutz (Foundation for Data Protection) gave an overview of the requirements that AI should meet in order to ensure responsible and data protection-compliant use.

For Paul Nemitz of the European Commission, AI is already omnipresent and has taken on an important role. Regarding the trustworthiness of AI, his appeal to politicians is to make regulations innovative, positive and plausible through adequate regulations. Future laws should create a framework of trust. After all, AI can be used as a valuable technology that respects fundamental human rights and serves the common good. It should not control decisions made by humans, but instead respectfully complement them.

Martin Rost from the Unabhängigen Landeszentrum für Datenschutz Schleswig-Holstein (Independent State Center for Data Protection) proposes a list of criteria to approach regulations in the field of AI  application.  All speakers agreed that the use of AI must proceed in a transparent and comprehensible manner.

As a leading legal expert in the field of data protection law and AI, Professor Borges presented his expert opinion under the heading of "Potentials of AI with regard to data protection law." Borges explained that data protection law stands in tension with artificial intelligence. On the one hand, there are huge amounts of data from which AI feeds and optimizes itself; on the other hand, there is the demand to protect personal data. The goal is to find the right balance between benefits and protection of the use of personal data.
